A licen\u00e7a \u00e9 o afastamento do servidor por um per\u00edodo de 3 meses a cadas 5 anos para a participa\u00e7\u00e3o em um curso de capacita\u00e7\u00e3o profissional. Esta licen\u00e7a \u00e9 um direito dos servidores garantido em Lei e foi conquistado em 97 ap\u00f3s o Governo ter extinguido a Licen\u00e7a Pr\u00eamio (que era mais vantajosa para o servidor pois podia ser acumulada e, caso n\u00e3o utilizada em descanso, acumulada para contar em dobro para a aposentadoria ou recebida em pec\u00fania).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000; font-family: arial, helvetica, sans-serif; font-size: medium;\">Para aplicar o Decreto no \u00e2mbito dos \u00f3rg\u00e3os integrantes do Sistema de Pessoal Civil da Administra\u00e7\u00e3o Federal \u2013 SIPEC, dentre eles a PRF, o Minist\u00e9rio da Economia publicou a Instru\u00e7\u00e3o Normativa n\u00ba 201, de 11 de setembro de 2019, estabelecendo par\u00e2metros e regras, e o nosso Departamento o Of\u00edcio-Circular 114\/2019 da Divis\u00e3o de Legisla\u00e7\u00e3o de Pessoal aplicando a normativa ao nosso \u00d3rg\u00e3o.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000; font-family: arial, helvetica, sans-serif; font-size: medium;\">Entre a vig\u00eancia do Decreto e a publica\u00e7\u00e3o do documento do DPRF, as licen\u00e7as foram sobrestadas, mas agora os processos est\u00e3o sendo encaminhados para os servidores para a adequa\u00e7\u00e3o \u00e0s novas regras, e os novos pedidos j\u00e1 dever\u00e3o atentar para o novo formato.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000; font-family: arial, helvetica, sans-serif; font-size: medium;\">O que diz a Lei 8.112\/90:<\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">Art. 87. Ap\u00f3s cada quinqu\u00eanio de efetivo exerc\u00edcio, <\/span><span style=\"color: #000000;\">o servidor poder\u00e1, no interesse da Administra\u00e7\u00e3o<\/span><span style=\"color: #000000;\">, afastar-se do exerc\u00edcio do cargo efetivo, com a respectiva remunera\u00e7\u00e3o, por at\u00e9 tr\u00eas meses, para participar de curso de capacita\u00e7\u00e3o profissional.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">O SINPRF-SP analisou os textos normativos (o Decreto 9991, a IN 201 e o OC 114) e disponibiliza aqui uma rela\u00e7\u00e3o das mudan\u00e7as nas regras que j\u00e1 est\u00e3o valendo<\/span><span style=\"color: #000000;\">.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">S\u00e3o <\/span><span style=\"color: #000000;\">novas <\/span><span style=\"color: #000000;\">e<\/span><span style=\"color: #000000;\">xig\u00eancias:<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">Nos afastamentos por per\u00edodo superior a trinta dias consecutivos, o servidor <\/span><span style=\"color: #000000;\">dever\u00e1 requerer a <\/span><span style=\"color: #000000;\">dispensa d<\/span><span style=\"color: #000000;\">a fun\u00e7\u00e3o gratificada (Chefia);<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; O<\/span><span style=\"color: #000000;\"> hor\u00e1rio ou o local da a\u00e7\u00e3o de desenvolvimento <\/span><span style=\"color: #000000;\">tem que ser incompat\u00edvel com <\/span><span style=\"color: #000000;\">o cumprimento da jornada semanal de trabalho do servidor;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; No caso de curso de l\u00edngua estrangeira o curso dever\u00e1 ser <\/span><span style=\"color: #000000;\">presencial ou <\/span><span style=\"color: #000000;\">mediante <\/span><span style=\"color: #000000;\">interc\u00e2mbio, <\/span><span style=\"color: #000000;\">devendo ser atestado pela chefia imediata ser <\/span><span style=\"color: #000000;\">recomend\u00e1vel ao exerc\u00edcio de suas atividades;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; A <\/span><span style=\"color: #000000;\">carga hor\u00e1ria total d<\/span><span style=\"color: #000000;\">o curso ou d<\/span><span style=\"color: #000000;\">o conjunto de a\u00e7\u00f5es <\/span><span style=\"color: #000000;\">de desenvolvimento dever\u00e1 ser\u00a0<\/span><span style=\"color: #000000;\">ao menos de 31<\/span><span style=\"color: #000000;\"> horas semanais;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; O qua<\/span><span style=\"color: #000000;\">ntitativo de servidores em licen\u00e7a capacita\u00e7\u00e3o simultaneamente <\/span><span style=\"color: #000000;\">n\u00e3o poder\u00e1 ser superior a <\/span><span style=\"color: #000000;\">2%<\/span><span style=\"color: #000000;\"> dos servidores em exerc\u00edcio <\/span><span style=\"color: #000000;\">na Regional;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">A <\/span><span style=\"color: #000000;\">manifesta\u00e7\u00e3o da chefia imediata do servidor <\/span><span style=\"color: #000000;\">dever\u00e1 avaliar<\/span><span style=\"color: #000000;\"> expressamente a compatibilidade entre a solicita\u00e7\u00e3o e o planejamento dos afastamentos, levando em conta os per\u00edodos de maior demanda de for\u00e7a de trabalho da unidade;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">O prazo entre o requerimento do servidor e o in\u00edcio do afastamento solicitado <\/span><span style=\"color: #000000;\">n\u00e3o <\/span><span style=\"color: #000000;\">deve ser <\/span><span style=\"color: #000000;\">inferior a 60 (sessenta) dias;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">Dever\u00e1 constar do processo <\/span><span style=\"color: #000000;\">manifesta\u00e7\u00e3o da unidade de gest\u00e3o de pessoas do \u00f3rg\u00e3o indicando sua concord\u00e2ncia e aprova\u00e7\u00e3o justificada quanto \u00e0 solicita\u00e7\u00e3o, <\/span><span style=\"color: #000000;\">bem como a <\/span><span style=\"color: #000000;\">anu\u00eancia da autoridade m\u00e1xima d<\/span><span style=\"color: #000000;\">a Regional<\/span><span style=\"color: #000000;\">;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">Os cursos \u00e0 <\/span><span style=\"color: #000000;\">dist\u00e2ncia <\/span><span style=\"color: #000000;\">dever\u00e3o possuir <\/span><span style=\"color: #000000;\">supervis\u00e3o, orienta\u00e7\u00e3o ou tutoria.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000; font-family: arial, helvetica, sans-serif; font-size: medium;\">Tamb\u00e9m destacamos outras mudan\u00e7as na forma de an\u00e1lise e deferimetno que v\u00e3o afetar a utiliza\u00e7\u00e3o pelo servidor:<\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">Recebido o processo da unidade de lota\u00e7\u00e3o do servidor, a unidade de gest\u00e3o de pessoas dever\u00e1 fazer constar do processo e levar em conta <\/span><span style=\"color: #000000;\">em sua <\/span><span style=\"color: #000000;\">manifesta\u00e7\u00e3o <\/span><span style=\"color: #000000;\">o <\/span><span style=\"color: #000000;\">tempo de efetivo exerc\u00edcio, da exist\u00eancia de per\u00edodos de afastamento por licen\u00e7a para tratar de assuntos particulares, per\u00edodos de gozo de licen\u00e7a para capacita\u00e7\u00e3o ou <\/span><span style=\"color: #000000;\">para programa de p\u00f3s-gradua\u00e7\u00e3o;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">Instru\u00eddo o processo <\/span><span style=\"color: #000000;\">na Regional<\/span><span style=\"color: #000000;\">, ele ser\u00e1\u00a0<\/span><span style=\"color: #000000;\">tamb\u00e9m submetido <\/span><span style=\"color: #000000;\">a <\/span><span style=\"color: #000000;\">an\u00e1lise e manifesta\u00e7\u00e3o da <\/span><span style=\"color: #000000;\">D<\/span><span style=\"color: #000000;\">ivis\u00e3o de Legisla\u00e7\u00e3o de Pessoal \u2013 DLP\/CGGP <\/span><span style=\"color: #000000;\">em Bras\u00edlia<\/span><span style=\"color: #000000;\">;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">A compet\u00eancia para a <\/span><span style=\"color: #000000;\">concess\u00e3o d<\/span><span style=\"color: #000000;\">a\u00a0<\/span><span style=\"color: #000000;\">L<\/span><span style=\"color: #000000;\">icen\u00e7a <\/span><span style=\"color: #000000;\">C<\/span><span style=\"color: #000000;\">apacita\u00e7\u00e3o <\/span><span style=\"color: #000000;\">pa<\/span><span style=\"color: #000000;\">ss<\/span><span style=\"color: #000000;\">a a ser <\/span><span style=\"color: #000000;\">do Ministro da Justi\u00e7a e Seguran\u00e7a P\u00fablica;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">O<\/span><span style=\"color: #000000;\"> prazo para a decis\u00e3o final sobre o pedido e a publica\u00e7\u00e3o do eventual deferimento \u00e9 de trinta dias, contado da data <\/span><span style=\"color: #000000;\">da evolu\u00e7\u00e3o ao MJ com a devida instru\u00e7\u00e3o;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; O servidor <\/span><span style=\"color: #000000;\">s\u00f3 <\/span><span style=\"color: #000000;\">poder\u00e1 se ausentar das atividades ap\u00f3s a publica\u00e7\u00e3o do ato de concess\u00e3o da licen\u00e7a para capacita\u00e7\u00e3o;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; A licen\u00e7a para capacita\u00e7\u00e3o poder\u00e1 ser parcelada em <\/span><span style=\"color: #000000;\">at\u00e9<\/span><span style=\"color: #000000;\"> seis per\u00edodos e o menor per\u00edodo n\u00e3o poder\u00e1 ser inferior a quinze dias;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"color: #000000; font-family: arial, helvetica, sans-serif; font-size: medium;\">&#8211; Quando a licen\u00e7a para capacita\u00e7\u00e3o for concedida de forma parcelada, dever\u00e1 ser observado o interst\u00edcio m\u00ednimo de sessenta dias entre quaisquer per\u00edodos de gozo;<\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">Neste primeiro exerc\u00edcio a<\/span><span style=\"color: #000000;\">inda n\u00e3o ser\u00e1 exigido c\u00f3pia do trecho do <\/span><span style=\"color: #000000;\">Plano de Desenvolvimento de Pessoas &#8211; <\/span><span style=\"color: #000000;\">PDP do \u00f3rg\u00e3o onde estar\u00e1 indicada aquela necessidade de desenvolvimento;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211;<\/span><span style=\"color: #000000;\"> Al\u00e9m do <\/span><span style=\"color: #000000;\">certificado <\/span><span style=\"color: #000000;\">de conclus\u00e3o <\/span><span style=\"color: #000000;\">ou documento equivalente que comprove a participa\u00e7\u00e3o, <\/span><span style=\"color: #000000;\">o servidor dever\u00e1 juntar <\/span><span style=\"color: #000000;\">relat\u00f3rio de atividades desenvolvidas;<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">&#8211; <\/span><span style=\"color: #000000;\">O <\/span><span style=\"color: #000000;\">curso <\/span><span style=\"color: #000000;\">poder\u00e1 se<\/span><span style=\"color: #000000;\">r\u00a0<\/span><span style=\"color: #000000;\">conjugado com atividades pr\u00e1ticas em \u00f3rg\u00e3o<\/span><span style=\"color: #000000;\">s da\u00a0<\/span><span style=\"color: #000000;\">A<\/span><span style=\"color: #000000;\">dministra\u00e7\u00e3o <\/span><span style=\"color: #000000;\">P<\/span><span style=\"color: #000000;\">\u00fablica ou de outros pa\u00edses ou <\/span><span style=\"color: #000000;\">ainda <\/span><span style=\"color: #000000;\">em organismos internacionais, ou <\/span><span style=\"color: #000000;\">com a <\/span><span style=\"color: #000000;\">realiza\u00e7\u00e3o de atividade volunt\u00e1ria em entidade que preste servi\u00e7os dessa natureza, no Pa\u00eds ou no exterior.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #000000; font-family: arial, helvetica, sans-serif; font-size: medium;\">Exig\u00eancia ilegal<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">As novas normas torna<\/span><span style=\"color: #000000;\">ram<\/span><span style=\"color: #000000;\"> o deferimento mais restrito, mas uma delas extrapola o poder regulamentar impedindo o gozo por parte do efetivo: o <\/span><span style=\"color: #000000;\">Par\u00e1grafo \u00fanico do <\/span><span style=\"color: #000000;\">Artigo 27 <\/span><span style=\"color: #000000;\">do Decreto 9991\/2019, ao limitar o direito a 2% dos servidores do \u00f3rg\u00e3o, impossibilita que servidores que tenham cumprido todos os requisitos se beneficiem do direito legal.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">Como cada servidor tem direito a 3 meses <\/span><span style=\"color: #000000;\">e s\u00f3 pode utilizar o afastamento no interst\u00edcio de 5 anos ap\u00f3s o per\u00edodo aquisitivo (a licen\u00e7a n\u00e3o \u00e9 cumulativo) <\/span><span style=\"color: #000000;\">o limite deveria ser de 5%. V<\/span><span style=\"color: #000000;\">amos fazer a seguinte conta:<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"color: #000000; font-family: arial, helvetica, sans-serif; font-size: medium;\">em 60 meses (5 anos) s\u00e3o poss\u00edveis 20 licen\u00e7as de 3 meses (20 x 3 = 60);<\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">em um \u00f3rg\u00e3o de 100 servidores o limite para que todos pudessem usufruir o benef\u00edcio seria de 5 servidores por vez (5 x 20 = 100); <\/span><span style=\"color: #000000;\">e<\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 90px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">em um \u00f3rg\u00e3o com 500 servidores <\/span><span style=\"color: #000000;\">(PRFs e ADMs) <\/span><span style=\"color: #000000;\">o limite seria de 25 servidores\u00a0<\/span><span style=\"color: #000000;\">(25 x 20 = 500).<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">O SINPRF-SP levar\u00e1 esta disc<\/span><span style=\"color: #000000;\">uss\u00e3o \u00e0 FenaPRF para que seja estudado o caminho jur\u00eddico para a altera\u00e7\u00e3o do Decreto, tendo em vista sua ilegalidade.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\">Enquanto isso nosso Sindicato <\/span><span style=\"color: #000000;\">continua \u00e0 disposi\u00e7\u00e3o p<\/span><span style=\"color: #000000;\">ara auxiliar <\/span><span style=\"color: #000000;\">nossos sindicalizados <\/span><span style=\"color: #000000;\">a vencer <\/span><span style=\"color: #000000;\">quaisquer <\/span><span style=\"color: #000000;\">dificuldades impostas pela <\/span><span style=\"color: #000000;\">nova <\/span><span style=\"color: #000000;\">norma.<\/span><\/span><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Licen\u00e7a Capacita\u00e7\u00e3o Em 06 de setembro \u00faltimo passou a viger o Decreto n\u00ba 9.991\/2019, alterando a regulamenta\u00e7\u00e3o sobre a Licen\u00e7a Capacita\u00e7\u00e3o prevista no Artigo 87 da Lei n\u00ba 8112\/90.
