{"id":13440,"date":"2019-01-09T11:15:58","date_gmt":"2019-01-09T13:15:58","guid":{"rendered":"https:\/\/mjtom.com.br\/site1\/?p=13440"},"modified":"2022-01-07T13:03:21","modified_gmt":"2022-01-07T16:03:21","slug":"plantao-voluntario-x-auxilio-transporte","status":"publish","type":"post","link":"https:\/\/sinprfsp.org.br\/index.php\/2019\/01\/09\/plantao-voluntario-x-auxilio-transporte\/","title":{"rendered":"Plant\u00e3o Volunt\u00e1rio x Aux\u00edlio Transporte"},"content":{"rendered":"<div class=\"descricao\">\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium; color: #000000;\">O primeiro \u201cequ\u00edvoco\u201d na regulamenta\u00e7\u00e3o do IFR veio na pr\u00f3pria Instru\u00e7\u00e3o Normativa 129\/2018, de 27\/11\/2018, que, em seu Artigo 8\u00ba, veta indevidamente a participa\u00e7\u00e3o de PRFs que tenham \u201c<em>hist\u00f3rico recente de afastamento<\/em>\u201d.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium; color: #000000;\">A Administra\u00e7\u00e3o criou uma barreira impr\u00f3pria, discriminado ilegalmente aquele que se afastou por motivo m\u00e9dico, e imp\u00f4s uma quarentena arbitr\u00e1ria de 60 dias sem qualquer fundamenta\u00e7\u00e3o m\u00e9dica a servidores que j\u00e1 se encontram em plena atividade.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium; color: #000000;\">A puni\u00e7\u00e3o velada sob a desculpa de cuidados com a sa\u00fade dos servidores, e que exorbita a esfera de compet\u00eancia do administrador, foi questionada por alguns colegas diretamente atingidos pela restri\u00e7\u00e3o por meio de Recursos Administrativos e os processos foram encaminhados para Bras\u00edlia para an\u00e1lise e decis\u00e3o.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium; color: #000000;\">A restri\u00e7\u00e3o ao plant\u00e3o, al\u00e9m de ferir esferas de compet\u00eancia (apenas o m\u00e9dico perito pode dizer que um servidor tenha alguma restri\u00e7\u00e3o m\u00e9dica) e toda a pol\u00edtica de gest\u00e3o de pessoal do Governo Federal que estimula o servidor a cuidar da pr\u00f3pria sa\u00fade, tamb\u00e9m \u00e9 discriminat\u00f3ria e, portanto, pode ser caracterizada como Improbidade Administrativa posto que a Igualdade \u00e9, em nossa Ordem Constitucional, mais do que mera proposi\u00e7\u00e3o program\u00e1tica, um princ\u00edpio com dimens\u00e3o objetiva positivada.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000; font-family: arial,helvetica,sans-serif; font-size: medium;\">A novidade agora \u00e9 o Despacho Informativo n\u00ba 2813\/2018 (SEI n\u00ba 16235834), divulgado por e-mail nesta segunda-feira e assinado pela Divis\u00e3o de Recursos Humanos, que cita a Portaria <em><span style=\"font-style: normal;\">n\u00ba 130 do Minist\u00e9rio da Seguran\u00e7a P\u00fablica:<\/span><\/em><\/span><\/p>\n<p style=\"padding-left: 90px; text-align: justify;\"><span style=\"color: #000000;\"><em><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium;\">\u201cArt. 1\u00ba O pagamento da Indeniza\u00e7\u00e3o pela Flexibiliza\u00e7\u00e3o Volunt\u00e1ria do Repouso Remunerado seguir\u00e1 as disposi\u00e7\u00f5es contidas na presente regulamenta\u00e7\u00e3o.<\/span><\/em><\/span><\/p>\n<p style=\"padding-left: 90px; text-align: justify;\"><span style=\"color: #000000;\"><em><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium;\">Par\u00e1grafo \u00fanico. font-size: medium; color: #000000;\"><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">O Aux\u00edlio-Transporte, institu\u00eddo pela Medida Provis\u00f3ria n\u00ba 2.165\/2001, ser\u00e1 pago:<\/span><\/span><\/span><\/span><\/em><\/span><\/p>\n<p style=\"padding-left: 90px; text-align: justify;\"><span style=\"color: #000000;\"><em><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium;\"><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\">\u201c<span style=\"font-weight: normal;\">Art.1\u00ba (\u2026) nos deslocamentos de suas resid\u00eancias para os locais de trabalho e vice-versa, excetuadas aquelas realizadas nos deslocamentos em intervalos para repouso ou alimenta\u00e7\u00e3o, durante a jornada de trabalho, e aquelas efetuadas com transportes seletivos ou especiais.\u201d<\/span><\/span><\/span><\/span><\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium; color: #000000;\"><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">A <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">incompat<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">ibilidade constante do Artigo 3\u00ba da mesma Medida Provis\u00f3ria diz respeito apenas a <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">\u201c<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><em><span style=\"font-weight: normal;\">indeniza\u00e7\u00e3o ou aux\u00edli<\/span><\/em><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">o <\/span><\/span><\/span><\/span><\/em><span style=\"text-decoration: underline;\"><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><em>pago sob o mesmo t\u00edtulo ou id\u00eantico fundamento<\/em><\/span><\/span><\/em><\/span><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">\u201d<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">. <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">Sem esta leitura correta o Aux\u00edlio-transporte seria incompat\u00edvel com o Aux\u00edlio Alimenta\u00e7\u00e3o, <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">por exemplo, ou a Gratifica\u00e7\u00e3o por Hora Aulas.<\/span><\/span><\/span><\/span><\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium; color: #000000;\"><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">Diante desta (novamente) equiv<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">oc<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">ada interpreta\u00e7\u00e3o <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">por parte da unidade central do \u00d3rg\u00e3o em Bras\u00edlia, o SINPRF-SP sugere que os PRFs continuem solicitando o Aux\u00edlio-Transporte referente a TODOS os deslocamentos<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">feitos para ir trabalhar (plant\u00f5es, reuni\u00f5es de delegacia, apresenta\u00e7\u00e3o em Foruns, eventos de capacita\u00e7\u00e3o, etc). A solicita\u00e7\u00e3o ser\u00e1 encaminhada, nos termos da Lei 9.784\/99, para aprecia\u00e7\u00e3o em grau recursal no Departament<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">o. <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">Em paralelo o <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><strong>SINPRF-SP<\/strong><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\"> oficiar\u00e1 o Departamento alertando para o erro. <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">Se a decis\u00e3o mantiver o indeferimento, entenderemos <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">que o ato se constitui em Improbidade Administrativa tipificada no caput do Artigo 11 da Lei 8.429\/92 (viola\u00e7\u00e3o da legalidade).<\/span><\/span><\/span><\/span><\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium; color: #000000;\"><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">O alerta do Sindicato, mediante of\u00edcio encaminhado \u00e0 \u00e1rea respons\u00e1vel pela \u201cinterpreta\u00e7\u00e3o\u201d, visa caracterizar o do<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">l<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">o necess\u00e1rio \u00e0 tipifica\u00e7\u00e3o da Improbidade conforme decis\u00e3o d<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">e 2012 do<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\"> S<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">uperior Tribunal de Justi\u00e7a <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">(STJ, Informativo n\u00ba 0495). <\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">E mais do que isso o TRF4 j\u00e1 entendeu que basta um \u201c<\/span><\/span><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><em><span style=\"font-weight: normal;\">dolo gen\u00e9rico<\/span><\/em><\/span><\/span><\/em><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">\u201d, ou seja, que o agente queira praticar o ato e que este ato viole os princ\u00edpios da Administra\u00e7\u00e3o P\u00fablica para que se configure a improbidade, n\u00e3o se exigindo que o agente tenha a inten\u00e7\u00e3o de violar os princ\u00edpios.<\/span><\/span><\/span><\/span><\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif; font-size: medium; color: #000000;\"><em><span style=\"font-variant: normal;\"><span style=\"letter-spacing: normal;\"><span style=\"font-style: normal;\"><span style=\"font-weight: normal;\">Existe uma li\u00e7\u00e3o que aprendemos muito cedo na PRF: cada um tem sua matr\u00edcula. Est\u00e1 m\u00e1xima diz que cada um \u00e9 respons\u00e1vel e responde por seus atos.
